The South Selah Neighborhood Association’s appeal of the City of Selah’s approval of building permits for Carl Torkelson and Joe Kelly for a development at 605 Southern Avenue has been denied.

Last Monday, Patrick Spurgin, Selah’s Hearing Examiner, issued his ruling, denying the association’s request that the development be halted.

The Class I use appeal was referred to Spurgin who was given jurisdiction to hear the appeal by the Selah City Council. Spurgin declined to comment on his decision since it is “quasi-judicial.”

Dave Hoffert, a member of the South Selah Neighborhood Association said he and other members of the association did not understand Spurgin’s reasoning for the denial, and will consider appealing their case to Yakima County Superior Court.

Hoffert said the association has received calls encouraging the group to “take it to the end.”

“It’s our right to appeal it,” Hoffert said. “Perhaps someone away from the city could make a ruling.”

Hoffert said the group will meet with attorney James Carmody within the next few days to make a decision on an appeal.
